Welcome to Lingom8 ("the Service"), a subscription-based language learning tool that uses an AI agent to facilitate interactive language learning. By using the Service, you agree to the following terms and conditions. Please read them carefully before subscribing.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Service.

2. Eligibility

The Service is available to individuals aged 13 years or older. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

3. Description of the Service

Lingom8 provides users with an interactive platform to learn a new language via conversations with an AI-powered agent. The service is subscription-based.

4. Subscription and Payment

Price: The subscription fee for the Service will be disclosed at the time of registration and is subject to change at Lingom8’s discretion.

Billing: Payment will be charged to your payment method on a recurring monthly basis unless canceled at least 24 hours before the end of the current subscription period.

Renewal: Your subscription will automatically renew each month unless canceled.

Cancellation: You may cancel your subscription through the account settings in the Service or by contacting our support team.

5. Refund Policy

Refund Requests: Refunds for subscription fees may be requested within the first 7 days of a new billing cycle if you are unsatisfied with the Service.

Eligibility: Refunds will only be granted if you have not used the Service substantially within the current billing period.

Processing: Approved refunds will be processed within 14 business days and credited to the original payment method.

Non-Refundable Conditions: Refunds will not be issued for partial months, after significant usage, or for repeated refund requests without justifiable reasons.

6. User Conduct

By using the Service, you agree to:

Use the Service only for lawful purposes.
Refrain from any activity that interferes with or disrupts the Service.
Avoid any misuse of the AI agent, including but not limited to offensive or abusive language.

7. Data Collection and Privacy

Personal Data: The Service may collect personal data such as your name, email address, and language learning preferences.

Data Storage: Conversations with the AI agent may be stored for quality improvement purposes and to enhance user experience.

8. Intellectual Property

All content provided by the Service, including but not limited to text, software, and trademarks, is the property of Lingom8 or its licensors. Users are granted a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes.

9. Limitations of Liability

Disclaimer: The Service is provided on an “as is” basis. Lingom8 makes no warranties regarding the reliability or accuracy of the AI-generated content.

Liability: To the maximum extent permitted by applicable law, Lingom8 will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service.

10. Modifications to the Service and Terms

Service Changes: Lingom8 reserves the right to modify or discontinue, temporarily or permanently, the Service with or without notice.

Terms Changes: We may update these Terms from time to time. Continued use of the Service after changes have been posted constitutes your acceptance of the new Terms.

11. Termination

Lingom8 reserves the right to suspend or terminate your access to the Service for any violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Estonia. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Estonia.
